MEDIA VAULT STANDARD LIMITED WARRANTY


Please read carefully the terms and conditions of X2X Ltd. and its affiliates (such entities, "X2X") official website and this Standard Limited Warranty Terms and Conditions (such warranty "Standard Warranty”, and collectively with other terms and conditions from X2X’s website “Terms") before purchasing a Media Vault product (hereinafter referred to as "Product").

After purchase, you can register and activate X2X Media Vault Support on the X2X official support website within 6 months after your Product purchase. Otherwise, you cannot purchase the X2X Media Vault support plan but can still register your Product on X2X official support website. An original Product invoice is required to register for the Standard Warranty. You need to upload your purchase invoice from a reseller partner in order to complete the X2X Media Vault Standard Warranty process.

According to the EU General Data Protection Regulation, US California Consumer Privacy Act and other applicable laws and regulations, X2X can process the personal data of any identifiable natural person (hereinafter referred to as “Data Subject”) to fulfill contractual obligations, to preserve overriding legitimate interests, and as otherwise described in X2X Privacy Policy located at https://codex.online/legal.

X2X will not provide the personal data of any Data Subject to any other persons or parties without written agreement and will only collect the following personal data: the data subject’s login information, account name, account activity, IP address, and any other information the Data Subject may provide X2X such as their preferences.

1. Standard Warranty Eligibility
A. X2X warrants its Products against defects in material and workmanship. Under normal use and service, every hardware portion of the Products will be free from physical defects in material and workmanship during the Standard Warranty period, or the Products will be repaired or replaced as determined by an authorized reseller and X2X.
B. The Standard Warranty term only applies to Products that cannot be used properly due to defects caused during manufacturing or by any of the materials used. For any Product defects that result from the aforementioned causes, X2X will provide repair or replacement services within the Standard Warranty period.
C. If the Product does not function properly during the Standard Warranty period, please return the Product as instructed by X2X. X2X will repair or replace the Product with new or used components with performance equal to the original components. If the components are unavailable, X2X will replace the original component with a higher-performing component.
E. An X2X Media Vault Support option is available for purchase to extend the basic online documentation and reseller support during the Standard Warranty period. This X2X Media Vault Support provides direct access to the X2X Support team. It provides phone contact, Team Viewer remote support access and coverage over a 24/7-timeframe to log and request support tickets. The Media Vault Support option is limited to Product support for products purchased by individuals or organizations from X2X, its authorized distributors and/or retailers and is limited to the Product only. X2X is not responsible for support of connected peripheral devices (OS platforms, workstations, network switches, or 3rd party application software added to the Media Vault or host platform).
F. The X2X Media Vault Support option does not apply to non-X2X (including Codex) brand hardware or software Products, even if these Products are packaged with or bound to the X2X Produc
G. X2X’s ability to provide support under the Standard Warranty may be limited in some countries or territories.
H. The Product is a hard disk-based device. X2X does not guarantee the compatibility and/or performance of its Products with third-party products or peripheral products. Under no circumstances does X2X guarantee the safety and security of any data stored on the Product.
2. Standard Warranty Period

The following Standard Warranty rules apply to the Products (namely, CX.0001021 – Deskside Media Vault; CX.0001022 – RM4000 Series; and CX.0001023 – RM6000 Series):

3 years (with 3-year global Standard Warranty*) with front-line support via authorized reseller and access to online documentation and FAQ and Tutorials.

* The global Standard Warranty coverage allows users who need Standard Warranty services to contact their nearest authorized X2X resellers for support where their NAS was purchased.
3. Non-Standard Warranty Products

The Standard Warranty does not cover the following:
  • Products outside the Standard Warranty periods.
  • Products with removed, damaged, or unrecognizable Standard Warranty labels.
  • Products that cannot be identified with serial numbers or bar codes.
  • Products that have been tampered with or repaired by third parties not authorized by X2X.
  • Improper use or handling of the Product's physical components during hardware installation and other manual operations that do not follow Product manual instructions.
  • Force majeure or acts of God such as floods, lightning, earthquakes, and other natural disasters, accidents, insects, war, vandalism, theft, power outages, or low voltage disturbances.
  • Peripheral products and other external devices including hard drives, batteries (including built-in batteries), accessories, and expendable parts such as slides, hard drives, and flash storage devices.
4. Repair and Replacement Terms of Service
  • X2X will provide you services upon receipt of the reseller request. X2X will provide services using new or used components with equivalent performance. If the components are unavailable, X2X will replace your original component with a higher performance component.
  • Before using the Standard Warranty RMA service, you are responsible for backing up your data and removing any confidential, exclusive and private information. X2X is not responsible for loss, recovery, or compromise of existing data, programs or loss of equipment.
  • X2X will repair or replace your Product within a reasonable amount of time. Upon receipt of your repaired or replaced Product, the remainder of your Standard Warranty period will remain in place for the Product.
  • Each party will pay for one-way shipping cost, for example, you will be charged freight costs involved in delivering the malfunctioning Product to X2X, and X2X will cover the freight costs for returning the replaced or repaired Product to you.
  • *Non-RMA Warranty Service is available in select regions. Please contact X2X Sales at sales@x2x.media or your local reseller to inquire on pricing and terms.
5. Limitation of Liability
  • X2X is not liable if the Product is found to be free of defects or if the defects and/or damage is due to unauthorized repairs caused by improper use, negligence, improper installation or testing.
  • You consent that X2X may download or use the software on the Product, collect system data, remotely control this Product, or modify the system settings of this Product during remote support. X2X may obtain system information on the Product and surrounding related devices, including but not limited to system logs, statistics, system configuration, and application activation records. Before initiating remote support, please confirm that any private or confidential information has been removed, backed up, deleted, or encrypted, and you agree that X2X will under no circumstances be liable for any damage or loss of your data during this period. Please do not agree with remote support if you do not agree with X2X's access to your Product.
  • UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY, WHETHER TORT, CONTRACT, PRODUCT LIABILITY, NEGLIGENCE, OR OTHERWISE, SHALL X2X, ITS PARTNERS OR ITS EMPLOYEES, SHAREHOLDERS, AND CONTRACTORS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES. ADDITIONALLY, X2X EXPRESSLY DISCLAIMS ITS LIABILITY FOR OTHER DAMAGES INCLUDING BUT NOT LIMITED TO HARDWARE AND SYSTEM DAMAGE, LOSS OF DATA, FINANCIAL LOSS, LOST PROFITS, LOSS OF USE, LOSS OF EQUIPMENT, INTERRUPTION OF REMOTE SUPPORT SERVICES, OR ANY CONTENT OBTAINED THROUGH REMOTE SUPPORT SERVICES.
  • In no event shall X2X's liability under the Standard Warranty exceed the total value of the amount you paid for the Product.
  • TO THE FULLEST EXTENT PERMITTED BY LAW, X2X DOES NOT RECOGNIZE ANY WARRANTIES, WHETHER OR NOT EXPRESSLY SPECIFIED IN LAW OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IN CASE SUCH DISCLAIMER OF IMPLIED WARRANTIES IS NOT PERMITTED BY LAW, THE DURATION OF IMPLIED WARRANTIES WILL BE LIMITED TO THREE YEARS.
6. Miscellaneous
  • You are ineligible to refunds, discount or Product replacements under this Standard Warranty, unless otherwise specified by law or instructed by X2X.
  • It is your responsibility to backup all existing data, software, and programs, and delete all existing data before sending the Product for Standard Warranty services. X2X is not responsible for loss, recovery, or compromise of existing data, programs or loss of equipment from Standard Warranty services provided by X2X.
  • It is your responsibility to guarantee the Product does not contain illegal files or data.
  • X2X might install system software updates as part of its service to prevent your Product system software from reverting to an earlier version.
  • Third-party applications installed on your Product might be incompatible or unable to work on your Product following the system software update.
  • If any provision of the Terms or if its application is deemed invalid, illegal or unenforceable in any respect, the validity, legality, or enforceability of any other provisions and applications herein shall not, in any way, be affected or impaired.
  • X2X reserves the right to change these Terms at any time.
  • This Standard Warranty does not affect in any way your statutory rights.
7. Jurisdiction and Applicable Laws
  • Any disputes, claims, or controversies in connection with or arising from the Terms, its construction, existence, interpretation, validity, or any breach hereof which cannot be amicably settled between you and X2X, will be finally and exclusively resolved by arbitration under the laws of the State of California unless other terms and conditions are applicable in your country.

X2X provides a 3-year limited hardware Standard Warranty service that covers all our storage products (expressly excludes any media and/or data contained on such products). The Standard Warranty comes with no hidden fees or additional costs. Users who want to avail Standard Warranty services only need to register their Product and call or email their nearest authorized X2X reseller.

The links below provide contact information for third party service providers who may provide data recovery services for your X2X enterprise supplied disk drive. If you use data recovery services from one of these providers listed below, X2X will not void any warranty associated with the disk drive you purchased from an authorized X2X reseller or distributor if you obtain from your service provider written verification, on the service provider’s company letterhead, that it has performed data recovery or other services on your hard drive. In all other instances, X2X's warranty is void if the disk drive exhibits a defect attributable to misuse or tampering, improper installation, alteration or to other causes as specified in our warranty policy.

Any agreement you reach with a service provider for data recovery services is a matter between you and the service provider. X2X makes no warranty, express or implied, and expressly disclaims all warranties regarding the services provided by the service provider, including, but not limited to, any warranty regarding the quality or reliability of the service provider’s services, non-infringement, merchantability, or fitness for a particular purpose. Your selection of the service provider is at your own risk. X2X assumes no liability for any loss or damages of any kind that relate to, arise out of or result from the performance of services by the service provider, including, but not limited to, any loss of data contained on an X2X enterprise supplied hard drive.

Many of the third-party data recovery service providers offer services worldwide. If you need data recovery services and do not see a provider specifically listed in your country, please contact an alternative service provider for possible information and assistance to meet your needs.
